Overview

Welcome to Bellora Sydney.

These Terms of Service (“Terms”) govern your use of the Bellora Sydney website and any purchases made through our online store.

Throughout these Terms, the terms “Bellora Sydney”, “we”, “us” and “our” refer to the business operating under the Bellora Sydney trading name.

By accessing our website, browsing our products or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

If you do not agree with these Terms, please do not use our website or place an order with us.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell our products to you.

1. Use of Our Website

You may use our website only for lawful purposes and in accordance with these Terms.

You must not:

Use our website for any unlawful or fraudulent purpose;
Attempt to gain unauthorised access to our website, systems or accounts;
Introduce viruses, malware or other harmful technology;
Interfere with the security or proper operation of our website;

3. Prices and Currency

Unless otherwise stated, prices displayed on the Bellora Sydney website are in Australian Dollars (AUD).

Prices include applicable Goods and Services Tax (GST) where required.

We may change our prices from time to time. Any price change will not affect an order that has already been accepted by us, except where there has been an obvious pricing error.

Discount codes, promotions and offers may be subject to additional conditions and may be changed or withdrawn in accordance with those conditions.

4. Payments

Payments are processed securely through Shopify Payments and the payment methods made available at checkout.

By submitting payment information, you represent that you are authorised to use the payment method selected.

Although Bellora Sydney displays and charges Australian customers in AUD, Bellora Sydney may use payment infrastructure associated with a business located outside Australia.

Your bank, card issuer or payment provider may therefore apply an international transaction fee or other fee in some circumstances, even where your purchase is charged in AUD.

Any such fee is determined and charged by your financial institution and is outside Bellora Sydney’s control.

5. Orders

Submitting an order through our website constitutes an offer to purchase the products in your order.

Receiving an automated order confirmation does not necessarily mean that we have accepted your order.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

A product is unavailable;
There is an obvious pricing or product information error;
Payment cannot be authorised;
We reasonably suspect fraud or unauthorised activity;
Shipping information is incomplete or invalid;
An order appears to have been placed for unauthorised resale or commercial purposes; or
We are unable to fulfil the order for another legitimate reason.

If we cancel an order after payment has been received, we will refund the relevant amount to the original payment method.

6. Order Changes and Cancellations

If you wish to change or cancel your order, please contact us at info@bellorasydney.com as soon as possible.

We will do our best to accommodate your request, but orders are processed quickly and we cannot guarantee that changes or cancellations can be made once processing has begun.

Once an order has been dispatched, it cannot be cancelled.

If your order has already been dispatched, you may be able to return it after receiving it in accordance with our Returns & Refunds Policy.

7. Shipping and Delivery

Order processing, estimated delivery times, tracking and other shipping information are set out in our Shipping Policy.

Delivery timeframes are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Occasional delays may occur due to circumstances outside our reasonable control, such as carrier delays, weather events, public holidays or peak shopping periods.

Nothing in this section limits any rights you may have under applicable consumer law.

8. Returns and Refunds

Change-of-mind returns are governed by our Returns & Refunds Policy.

Bellora Sydney currently offers eligible customers a voluntary 30-day change-of-mind return period, subject to the conditions set out in that policy.

This voluntary return policy is separate from and does not replace your rights under the Australian Consumer Law.

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, compensation or another remedy where a product does not comply with applicable consumer guarantees.

Nothing in these Terms is intended to exclude, restrict or modify any guarantee, right or remedy that cannot legally be excluded, restricted or modified.

Where any provision of these Terms conflicts with a mandatory right available to you under applicable consumer law, that mandatory right will prevail.

10. Promotions and Discount Codes

From time to time, Bellora Sydney may offer promotions, discount codes or special offers.

Unless otherwise stated:

Promotions cannot be exchanged for cash;
Discount codes may be subject to an expiry date;
Certain products may be excluded;
Only one discount code may be used per order where our checkout does not permit discounts to be combined; and
Promotions apply only during the advertised promotional period.

We may cancel or correct a promotion where there has been an obvious technical, pricing or administrative error.

11. Accuracy of Account and Order Information

You agree to provide current, complete and accurate information when placing an order.

This includes your name, email address, billing information, shipping address and other information reasonably required to process your purchase.

You retain ownership of your Customer Content.

By voluntarily submitting Customer Content to us, you grant Bellora Sydney a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and publish that content in connection with operating and promoting Bellora Sydney, including on our website, social media channels, emails and advertising.

Where reasonably practicable, we may identify content using your first name, initials, social media handle or other information associated with your submission.

You represent that:

You own or have permission to submit the content;
The content does not infringe another person’s rights;

Any limitation contained in these Terms applies only to the extent permitted by law.

19. Indemnity

You are responsible for loss or damage reasonably suffered by Bellora Sydney as a direct result of your unlawful use of our website, your material breach of these Terms or your infringement of another person’s rights.

This section does not require you to compensate Bellora Sydney for losses caused by Bellora Sydney’s own acts, omissions, negligence or breach of law.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary or, where appropriate, severed.

The remaining provisions will continue to apply.
